In his opening statements, the chief prosecutor for the state, Creighton Waters, presented a sequence of events and detailed the evidence that was gathered from the night that Maggie and Paul Murdaugh were murdered.
"As if they didn't see a threat coming from their attacker," Waters added, "the evidence will show that both of the victims were shot at close range without any defensive wounds."
During the course of the trial, the jurors are going to hear about the following categories of evidence, according to Waters's description.
Waters predicted that there would be a significant amount of forensic evidence related to the investigation.
Among the items listed were remnants of gunfire and evidence from a cell phone.
When asked about the significance of the evidence obtained from the cell phone, Waters stated, "This is going to be crucial."
During the opening statements of the defense, attorney Dick Harpootlian referred to the phone records as being incomplete.
Harpootlian said that the cruel manner in which Murdaugh's wife and kid were "executed" makes it "not believable" that Murdaugh had any participation in the incident.
He said that blood would cover you from head to foot and that it would be impossible to wash it off.
Harpootlian stated that there was no blood found on Murdaugh's clothing throughout the investigation.
Harpootlian made a point to emphasize the absence of "direct evidence" by stating, "There is no eye witness."
According to Harpootlian, the presumption is that he is innocent. "Unless the state proves its case beyond a shadow of a doubt, you cannot convict him," the judge said.
